California Assembly Bill 306 (AB 306) is moving rapidly throughly the Legislature and could have serious consequences for building safety and local authorities. Because AB 306 is sponsored by Assembly Speaker Robert Rivas, it is on a fast track and could reach the Assembly floor as early as Monday.
What is AB 306?
If passed, AB 306 would freeze state code updates for residential units from June 1, 2025, to June 1, 2031, unless those changes are deemed “emergency standards,” address home hardening and are proposed by the State Fire Marshal, or concern single stairway proposals, adaptive reuse or water reuse. Local jurisdictions would also face serious restrictions on adopting their own amendments.
Why We Oppose AB 306:
- No Impact on Housing Costs: Every study on code updates has found that they have no appreciable impact on housing first costs.
- Risks Safety & Resiliency: The bill puts building safety and resiliency at risk by restricting updates that address critical safety concerns.
- Limits Innovation & Cost-Saving Measures: It restricts the state’s ability to incorporate new technologies, best practices, and other cost-saving innovations that could benefit the industry and consumers.
